In October 2024, the IRS announced it was processing approximately 400,000 ERC claims, totaling about $10 billion. Despite this progress, a report to Congress revealed that the IRS still had about 1.2 million unprocessed ERC claims, highlighting ongoing delays. To address the backlog and ensure compliance, the IRS has been issuing disallowance and recapture letters to entities with improper claims. We will also discuss the credit’s current state of affairs, including congressional action, audits and litigation.

  • Influence an auditor or appeals officer about the strength of your client's claim 

  • Identify taxpayers who should consider offensive litigation (refund claims)

  • Understand and apply Section 280C when amending returns
